Kesimpulan Konferensi
Walau baru bisa tidur lagi sekitar jam enam pagi, jam 7 saya sudah bangun. Mandi air hangat, lalu menuju restoran buat sarapan. Kali ini saya adalah orang pertama yang tiba di Palm Restoran. Memang sejak malam, perut keroncongan.
Orang kedua yang datang, pengacara asal Malaysia Moehideen. Ndilalah rombongan ketiga, dua orang delegasi asal Iran, ternyata salah satunya bisa bahasa Inggris. “Mereka mau pulang hari ini, sebelum konferensi selesai,”ujar Moehideen kepadaku.
Semua pemimpin kelompok diskusi memaparkan kesimpulan hasil diskusi. Lalu meminta tanggapan peserta. Para peserta berbahasa Arab, seperti dalam diskusi kelompok, mereka saling berebut bicara. Bahkan ada yang punya suara keras, tak menggunakan mike. Para penterjemah rpotes, karena merraka tak bisa melakukan tugasnya. Jika tanpa mike mereka tak bisa mendengar, apa yang mereka katakan.
Usai pemaparan kesimpulan dan berbagai tanggapan itu. Saatnya rapat tim perumus. Lalu mereka berembuk merumuskan semua hasil konferensi. Setelah tiga jam rembukan, kami dipanggil lagi untuk masuk, mendengarkan kesimpulan. “Maf, baru tersedia kesimpulan dalam bahasa Arab,”ujar Vida Warde sambil membagkan kertas kesimpulan berbahasa Arab. “Nanti yang bahasa Inggris, kami kirim lewat email,”ujarnya.
Inilah hasil kesimpulan dalam bahasa Inggris yang dikirimkan panitia konferensi, yang baru diterima ku dua hari lalu.

Palestine from Settlement to Violation of Human Rights
The most important recommendations of the "Criminal Responsibility for Human Rights Violations and International Prosecution" workshop
1. Urging the Palestinian Authority to compose and form a team of legal experts specialized in international law to discuss the entry of Palestine to the Rome Statute, besides thoroughly examining this judicial institution and the extent to which it can achieve the Arab Palestinian people's rights and interests in addition to the prosecution of the Zionist entity's war criminals.
2. The creation of a Palestinian specialized prosecution whose mission is to investigate and document the Zionist entity's crimes and violations against the Arab Palestinian people and usurping their land, and to provide the international community with the forensic evidence.
3. Training Arab and Palestinian cadres specialized in documenting the Zionist entity's crimes and violations, through a training center equipped with the latest scientific technologies in the field of war crimes' documentation.
4. To benefit from the principle of Universal Jurisdiction via activating criminal proceedings in the countries that have adopted this principle against the leaders of the Zionist entity to prosecute them for their practices and actions that are contrary to the international humanitarian law and international criminal law.
5. To constantly work within the UN General Assembly to try to pass a resolution establishing a legal tribunal of international character (mixed) like the Sierra Leone Tribunal and the Special Criminal Tribunal for Lebanon to examine the crimes committed in the Palestinian occupied territories.
6. Activating the principle of recourse to the Prosecutor of the International Criminal Court (ICC) through the provision of the perpetrated crimes together with evidence and documents so that he would activate criminal proceedings against the Zionist entity's leaders before the ICC pursuant to Article 15 of its statute.
7. Heading to the International Court of Justice to issue a resolution condemning the Zionist entity's violations pursuant to the Convention on the Prevention and Punishment of the Crime of Genocide (1948), as was the case in 1993 in the Republic of Bosnia when the latter filed, based on the said Convention, a complaint against the Republic of Serbia on charges of committing genocide against the Bosnian people.
8. Urging the Arab states to amend their criminal legislations to allow for activating the introduction of the Universal Jurisdiction principle, thus making it possible to prosecute the perpetrators of international crimes, including the Zionists criminals.
9. To activate complaints and petitions relating to condemnation and prosecution of the Zionist entity for violating the international commitments and agreements it has signed (crimes of racial discrimination, the building of the wall, water theft, violation of the Four Geneva Conventions).

Concluding Statement

At this delicate stage of the life of the nation and amidst an Arab and international scene that represents a cover supporting the Zionist project, as the Arab peaceful popular mobility has been robbed in favor of forces belonging to the US-Western strategy which aims to support the Zionist entity and stand against the resistance in all its forms, where the Arab and Palestinian resistance forces emerge strongly now in their war against the Zionist occupying entity, the Arab satellite regimes and the imperialist hegemony, as a glimmer of the historic hope to recover rights and the return of its owners to their historical land from the river to the sea,
Thus, came this initiative to hold this nationalist legal event in defense of the Arab right in Palestine, where several Arab and international non-governmental organizations and legal experts gathered in Beirut on February 16 and 17, 2013, at the invitation of the Arab Nation's League and the International Network for Rights and Development, to hold an international conference on Palestine under the title of: Palestine from Settlement to Racism and Human Rights Violations.
The conference was launched with an opening session that was attended by representatives of non-governmental organizations from four continents along with the conference organizers and the host country. The Conferees adopted a resolution to launch the march of "Legal Resistance".
Then, the congress held a first general session under the title of "the Zionist Entity and the Extent of its Legitimacy in light of International Law" in which several general studies were discussed before the conference turned into workshops on:
A. Al-Quds
B. The Zionist Entity's Racism and the Right of Resistance
C. Criminal Liability for Human Rights' Violations of and International Prosecution
The workshops endorsed many resolutions and recommendations that were adopted by the Conference in its final plenary session, including:
1. To internationally prosecute all the institutions and companies that support the Zionist entity; and to popularly pressure the governments supporting the Zionist colonial project to change their position or to boycott these governments economically and politically.
2. Emphasizing the Arab Palestinian identity as a weapon of cultural resistance in the confrontation against Judaization and robbery of the Palestinian heritage.
3. The necessity of adopting an international project that responds to the challenge reflected by the international judicial system as for concurrent jurisdiction, standardized terminology, and issues of forced displacement.
4. Specialized training in the collection of legal evidence and documents proving Arab rights in Palestine through identifying the circles of physical and oral reference and evidence.
5. Organizing a conference to follow up the issue of legal resistance after two months in commemoration of the twenty-fifth anniversary of the assassination of Martyr-Leader Abu Jihad, as an activation of the UN Security Council's Resolution 611 of 1988, which condemned the Zionist entity's crime of aggression, political assassination, and violation of the United Nations' Charter.
6. To work on the revision of the Zionist entity's UN membership due to its constant breach of the UN Charter and its boycott of the Human Rights Council.
7. To take the initiative of establishing popular Arab and international courts in many countries to bring to justice the perpetrators of war crimes and crimes against humanity both Zionist individuals and bodies within or outside the occupied territories.
8. Emphasizing the Arab Islamic and Christian right in properties in and around al-Quds through restoring consideration to Endowments in Palestine and the Palestinian heritage preservation associations.
9. Training Arab and Palestinian rights cadres specialized in documenting Zionist crimes and violations, equipped with the latest scientific technologies in the field of war crimes' documentation, besides creating judicial bodies to investigate these aggressions.
10. To have recourse to the International Court of Justice to issue a resolution condemning the Zionist entity's violations on the basis of the Convention on the Prevention and Punishment of the Crime of Genocide.
11. Restoring consideration to the UN General Assembly's Resolution 3347 which regards Zionism as a form of racism.
12. Working on establishing the culture of resistance in the agenda and slogans of the Arab mobility.
Finally, the conferees adopted the call for holding an international conference to follow up and activate the legal resistance proceedings in accordance with international humanitarian law and international criminal law.
Intinya, harus ada tokoh dari Israel yang diseret ke Mahkamah Pidana Internasional, karena kejahatan terhadap kemanusiaan, terutama terthadap rakyat Palestina.
